1. Introduction
The German Business Association (hereinafter referred to as “GBA”) is committed to ensuring the protection of personal data and maintaining transparency regarding the collection, processing, use, and safeguarding of such data. By accessing or utilizing GBA’s services, including but not limited to its website, membership platforms, events, and communications, the user expressly acknowledges and agrees to be bound by the terms set forth in this Privacy Policy and these Terms & Conditions. These provisions may be amended or updated from time to time in accordance with changes in applicable legislation or operational requirements. Continued use of GBA services after publication of any updates constitutes acceptance of such changes.
2. Privacy Policy

2.2 Legal Basis for Processing
GBA processes personal data based on the following lawful grounds:
– Consent provided by the subject of data (e.g., newsletters, surveys, event participation) – Performance of a contract (e.g., membership agreements, event registrations).
– Compliance with legal obligations.
– Other grounds in accordance with the prevailing regulations of Vietnam.
2.3 Data Collection and Use
GBA may collect personal and professional data through, but not limited to, the following channels:
- Membership application forms;
- Event and workshop registration processes;
- Voluntary participation in surveys;
- Interactions via the GBA website and Glue Up membership platform.
The data collected may include, inter alia, full name, job title, company affiliation, contact details (such as email address and phone number), and history of participation in GBA-related activities.
Such data shall be collected and used exclusively for purposes including, but not limited to:
- Administration of membership benefits and directories;
- Organization and coordination of events, surveys, and communications;
- Enhancement of business networking and information-sharing opportunities;
- Dissemination of official GBA updates, services, and promotional materials.
2.4 Data Sharing and Transfer
Personal data may be disclosed or transferred as follows:
- Internally within the GBA Secretariat for the purposes of administration and service delivery;
- To the European Chamber of Commerce in Vietnam (EuroCham Vietnam), in connection with the joint GBA-EuroCham membership scheme;
- To third-party partners, only upon obtaining the data subject’s explicit consent or where such transfer is necessary for the implementation of joint programs or events.
GBA shall adopt all reasonably practicable technical and organizational measures to preserve the confidentiality, integrity, and security of personal data, in compliance with applicable data protection laws and regulations. Such measures include, but are not limited to, encryption of data in transit and at rest, restricted access based on roles, and incident response procedures.
2.5 Data Retention
GBA retains personal data only as long as necessary for the purposes stated in this Policy or as required by applicable laws. Retention periods are determined based on legal obligations, operational needs, and the nature of the relationship with data subjects. Upon expiry of such periods, data will be securely deleted or anonymized.
2.6 Data Subject Rights
Under applicable data protection laws, individuals have the right to:
– Request access to their personal data.
– Request correction or completion of inaccurate data.
– Request erasure of data under certain conditions
– Request restriction of processing.
– Object to processing based on legitimate interests.
– Request data portability to another controller.
– Withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

2.7 Surveys
By voluntarily completing and submitting any GBA-issued survey, the data subject consents to the collection and processing of the data provided therein for the exclusive purpose of research and service improvement. Where appropriate, such data may be anonymized and aggregated.
2.8 Events and Contact Sharing
To facilitate business networking and cooperation among members, GBA may share limited contact information (e.g., name cards) upon justified request. In such instances:
- GBA shall inform the individual and/or seek explicit consent prior to disclosing any personal data;
- GBA shall assess the purpose and legitimacy of such disclosure in accordance with its internal data governance principles.
GBA may also record photographs or videos during events. Such media may be used for GBA’s promotional and communication purposes. Attendees who wish to opt out of being photographed or recorded should inform GBA in advance or notify staff on-site.
2.9 Cookies and Tracking
GBA’s website may use cookies or similar technologies to enhance user experience, analyze site usage, and deliver relevant content.
2.10 Data Breach Notification
In the event of a personal data breach, GBA will notify affected individuals and the competent authorities as required under applicable laws, including within 72 hours on working days were mandated by Decree No. 13/2023/ND-CP
2.11 Data Storage
All data is securely stored in the US-West region (Northern California). For email delivery, our service provider, SendGrid, operates data centers located in the United States.
3. Terms & Conditions
3.1 Use of Website and Platforms
By accessing and using the GBA website or Glue Up platform, the user agrees not to:
- Engage in any activity that violates applicable laws or regulations;
- Upload, transmit, or disseminate any content that is harmful, offensive, defamatory, or unauthorized;
- Attempt to access, retrieve, or use the personal data of other users without proper authorization.
All content provided by GBA via its platforms is for general informational purposes only. GBA reserves the right to modify, update, or remove any content at its sole discretion without prior notice. Continued use of GBA services following any updates to these Terms & Conditions constitutes acceptance of such changes.
3.2 Intellectual Property
Unless expressly stated otherwise, all text, graphics, logos, images, documents, and software appearing on GBA platforms (including Glueup, Website, Linkedin & Facebook) are the intellectual property of GBA or its duly authorized service providers. No part of such content may be reproduced, copied, distributed, or transmitted in any form or by any means without the prior written authorization of GBA. Unauthorized use constitutes an infringement under applicable intellectual property laws.
3.3 External Links and Third-Party Content
GBA platforms may contain hyperlinks or references to external websites, content, or resources maintained by third parties. GBA does not monitor, endorse, or guarantee the accuracy, completeness, or reliability of such third-party content. To the fullest extent permitted by law, GBA disclaims all liability for any direct or indirect losses or damages arising from the use of third-party content accessed through its platforms.
3.4 Limitation of Liability
While GBA endeavors to ensure the accuracy and currency of all information provided, it makes no representations or warranties of any kind, express or implied, regarding the completeness, reliability, or suitability of such information. Under no circumstances shall GBA be liable for any loss or damage, whether direct, indirect, incidental, or consequential, arising out of or in connection with the use of GBA services or content, except where otherwise required by law.
Users are responsible for ensuring their own systems are protected against viruses or malicious code. GBA disclaims any liability for damages resulting from the use of its platforms or from downloaded files.
3.5 Membership Obligations
By applying for and accepting membership under the GBA-EuroCham scheme, members agree to:
- Abide by the governing statutes, by-laws, and regulations of both organizations;
- Respect the data privacy and rights of fellow members;
- Utilize GBA platforms and services in a responsible, lawful, and good-faith manner.
3.6 Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes arising in connection with these Terms & Conditions shall be submitted to the Vietnam International Arbitration Centre (VIAC) in accordance with its Rules of Arbitration, the place of arbitration shall be Ho Chi Minh City.
3.7 Indemnity
Users agree to indemnify and hold harmless GBA, its staff, and affiliates from any claims, damages, liabilities, or expenses arising out of the user’s breach of these Terms & Conditions or misuse of GBA’s services.
3.8 Termination and Suspension
GBA reserves the right to suspend or terminate a user’s access to its platforms or services at any time if the user breaches these Terms & Conditions or engages in activities detrimental to GBA’s interests.
3.9 Force Majeure
GBA shall not be liable for any delay or failure to perform obligations under these Terms & Conditions due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, or governmental restrictions.
3.10 Severability and Waiver
If any provision of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. Failure by GBA to enforce any right or provision shall not constitute a waiver of such right or provision.
